By purchasing a PropCred Radar subscription, creating or using a Radar account, inviting another user to Radar, submitting a report request or otherwise accessing the Services, you agree to these Terms.
If you accept these Terms on behalf of a company, real estate agency, partnership, trust or other organisation, you represent that you have authority to bind that organisation to these Terms.
1. DEFINITIONS
In these Terms:

Agency Administrator means the Named User who purchases or initially activates the Subscription, or another Named User subsequently designated as administrator.

Subscription means the Customer’s paid right to access Radar subject to these Terms.
Subscription Period means the period for which the Customer has paid and remains entitled to access Radar.
PART A – SUBSCRIPTION
2. Radar Subscription
2.1 Radar is a subscription service designed primarily for real estate agencies and real estate professionals.
2.2 A valid Subscription is required to access Radar unless PropCred expressly provides trial, promotional or complimentary access.
2.3 One Subscription relates to one Agency Account.
2.4 A Subscription may not be transferred to, shared with or used by another unrelated Agency without PropCred’s written consent.
2.5 Access to Radar is subject to:
a. payment of the applicable Subscription fees;
b. compliance with these Terms;
c. the Named User limits applying to the Subscription; and
d. any specific conditions clearly disclosed for the Subscription plan purchased.
3. Subscription Plans
Radar currently offers the following Subscription plans.
3.1 Monthly Subscription
The monthly Subscription currently known as MoM 149 No Lock In:
- costs $149 per month;
- is charged monthly;
- automatically renews each month unless cancelled; and
- has no minimum commitment beyond the current paid monthly Subscription Period.
The Customer may cancel before the next renewal date to prevent the next recurring charge.
Cancellation takes effect at the end of the current paid monthly Subscription Period.
3.2 Annual Subscription
The annual Subscription:
- costs $1,188 for 12 months;
- is charged in full upfront;
- is equivalent to $99 per month when averaged over 12 months; and
- automatically renews for a further 12-month period unless cancelled before renewal.
The annual Subscription is not billed at $99 each month. The Customer is charged $1,188 upfront for each 12-month Subscription Period.
Any reference to “$99/month”, “$99 per month equivalent” or similar wording describes the equivalent monthly rate only.
4. Automatic Renewal
4.1 Unless cancelled, a Subscription automatically renews at the end of each Subscription Period.
4.2 By purchasing a recurring Subscription, the Customer authorises PropCred and its authorised payment providers to charge the Customer’s nominated payment method for each recurring payment.
4.3 Monthly Subscriptions renew approximately monthly.
4.4 Annual Subscriptions renew approximately every 12 months.
4.5 The Customer is responsible for cancelling the Subscription before the relevant renewal date if the Customer does not wish it to renew.
4.6 PropCred may send renewal reminders or other Subscription communications but the Customer remains responsible for managing its Subscription.
4.7 Nothing in this clause limits rights which cannot lawfully be excluded.
5. Payments
5.1 Subscription prices are stated in Australian dollars.
5.2 GST will be charged or included as required by Australian law and will be shown where required.
5.3 Payments may be processed by third-party payment providers including WooPayments, Stripe or another payment provider used by PropCred.
5.4 The Customer authorises those providers to process payments associated with the Subscription.
5.5 PropCred does not ordinarily receive or store the Customer’s complete payment-card credentials where those credentials are processed directly by a payment provider.
5.6 The Customer must maintain a valid payment method while maintaining a recurring Subscription.
6. Failed Payments
6.1 If a recurring payment fails, PropCred may:
a. make further reasonable attempts to collect the payment;
b. request that the Customer update its payment method;
c. temporarily suspend access to Radar; and/or
d. cancel the Subscription if payment remains outstanding.
6.2 Suspension because of a failed payment does not extinguish an amount that had already become payable.
6.3 Radar access may be restored when outstanding amounts are successfully paid.
7. Pricing Changes
7.1 PropCred may change Subscription prices from time to time.
7.2 A price change will not retrospectively increase an amount already paid for the current Subscription Period.
7.3 PropCred will provide reasonable advance notice before a price increase applies to an existing recurring Subscription.
7.4 Unless otherwise stated, the revised price applies from the next renewal following the notified effective date.
7.5 If the Customer does not wish to pay the revised price, the Customer may cancel before that renewal.
8. Cancellation
Monthly Subscription
8.1 A monthly Subscription may be cancelled at any time.
8.2 There is no early termination fee for cancelling a monthly Subscription.
8.3 Cancellation prevents the next recurring payment and takes effect at the end of the current paid Subscription Period.
Annual Subscription
8.4 An annual Subscription may be cancelled at any time to prevent renewal for another annual Subscription Period.
8.5 Unless required by law or expressly agreed otherwise, cancellation of an annual Subscription does not create an entitlement to a pro-rata refund of the unused portion of the current Subscription Period merely because the Customer no longer wishes to use Radar.
8.6 Cancellation does not affect any statutory right or remedy available to the Customer.
9. Refunds
9.1 Subject to rights under applicable law, Subscription fees are not ordinarily refunded merely because:
a. the Customer changes its mind;
b. the Customer stops using Radar;
c. the Customer uses Radar less than expected;
d. a staff member leaves the Agency;
e. a Named User is replaced;
f. the Customer’s business circumstances change;
g. the Customer fails to cancel before a properly disclosed renewal; or
h. a Report provides a valuation, rental estimate or conclusion different from what the Customer or Client expected or desired.
9.2 Nothing in these Terms excludes or limits any right to a refund, re-supply or other remedy which cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
9.3 Where an issue can reasonably be remedied, PropCred may investigate the issue and, where appropriate, correct, regenerate or re-supply the affected Report or Service.
PART B – AGENCY ACCOUNTS AND USERS
10. Agency Account
10.1 Each Subscription is associated with one Agency Account.
10.2 The Agency Account is the primary account to which Reports are associated.
10.3 Reports generated by a Named User are considered Reports of the Agency Account and not exclusively of the individual Named User who submitted the Report request.
10.4 Authorised Named Users associated with the same Agency Account may therefore access Reports requested by other authorised Named Users within that Agency.
10.5 Removal or replacement of the Named User who created a Report does not remove that Report from the Agency Account.
11. Maximum Three Named Users
11.1 Unless PropCred expressly agrees otherwise, each Radar Subscription permits a maximum of three Named Users.
11.2 Each Named User must:
a. be an identifiable individual;
b. use their own email address;
c. have their own login credentials; and
d. be authorised by the Agency to use Radar.
11.3 One Named User login must not intentionally be shared between multiple people.
11.4 The Customer must not use generic, shared or rotating credentials for the purpose of circumventing the three-user limit.
11.5 The Customer may replace a Named User where reasonably required, including when a staff member leaves the Agency or changes role.
11.6 Named User replacement must not be systematically used to provide Radar access to more than three users under one Subscription.
11.7 PropCred may investigate use that reasonably appears to circumvent the Named User limit.
12. Agency Administrator
12.1 The person who initially purchases or activates the Subscription will ordinarily become the Agency Administrator.
12.2 Radar may allow the Agency Administrator to:
a. invite additional Named Users;
b. remove or replace Named Users;
c. update Agency details;
d. manage billing;
e. access Agency Reports;
f. update profile information; and
g. perform other account administration functions.
12.3 The Customer is responsible for ensuring that the Agency Administrator has authority to perform these functions.
12.4 PropCred may rely on instructions given through an authenticated Agency Administrator account unless it knows or reasonably suspects that the account has been compromised.
13. User Invitations
13.1 The Agency Administrator may invite additional Named Users up to the permitted user limit.
13.2 An invited user must create or activate their own Radar account.
13.3 An invitation does not create a separate Subscription.
13.4 All Named Users added to an Agency Account are subject to these Terms.
13.5 The Customer is responsible for ensuring that invited users are authorised members of the Agency.
14. Account Security
14.1 Named Users must keep their login credentials confidential.
14.2 Credentials must not knowingly be provided to another person.
14.3 The Customer must take reasonable precautions to prevent unauthorised access.
14.4 The Customer must notify PropCred promptly if it becomes aware or reasonably suspects:
a. compromised login credentials;
b. unauthorised use of Radar;
c. unauthorised access to the Agency Account;
d. a security incident associated with the Customer’s account; or
e. that a Named User is no longer authorised to use Radar.
14.5 Where reasonably necessary to protect the Customer, PropCred or other users, PropCred may:
a. reset credentials;
b. terminate active sessions;
c. require password changes; or
d. temporarily restrict account access.

15. Report Types
Radar currently provides two principal report types:
- Property Valuation Appraisal

PropCred may introduce additional Report types or functionality from time to time.

17.4 The Customer remains responsible for determining whether a formal valuation or other specialist report is required.
18. No Guaranteed Sale Price or Rental Outcome
18.1 Property appraisal involves professional judgement and market uncertainty.
18.2 A value, range, rental estimate, forecast or other conclusion contained in a Report represents an assessment based on information reasonably available when the Report was generated.

b. the price a purchaser will offer;
c. the price a vendor will accept;
d. the rent a property will achieve;
e. the rent a landlord or tenant will accept;
f. how quickly a property will sell or lease;
g. future market movements;
h. the outcome of negotiations;
i. that another agent will reach the same conclusion;
j. that a qualified valuer will reach the same conclusion; or
k. that a lender will adopt a Radar valuation.
18.4 Actual outcomes may be higher or lower than values or rental estimates appearing in a Report.
19. Market Conditions
19.1 Property and rental markets can change rapidly.
19.2 Reports reflect information and market conditions reasonably available at or around the time of preparation.
19.3 A Report should not be assumed to remain current indefinitely.
19.4 PropCred is not responsible for changes in market conditions occurring after a Report is prepared.
20. Property Information
20.1 Radar relies on information from multiple sources.
20.2 Information may include Customer Data, public information, third-party databases, property records, transaction records, listings information and other available data.
20.3 While reasonable care is taken, property information may be incomplete, incorrect, delayed or outdated.
20.4 Third-party data is not necessarily independently verified by PropCred.
20.5 The Customer should review material property characteristics before relying on or distributing a Report.
20.6 If the Customer identifies a material error, it should notify PropCred promptly.
21. Customer-Supplied Information
21.1 Radar may rely materially on property information supplied by the Customer.
21.2 The Customer must take reasonable care to provide accurate information concerning matters including:

22. No Physical Inspection
22.1 Unless expressly stated otherwise, PropCred does not physically inspect the property when preparing a Radar Report.
22.2 Information about property condition, improvements, defects, renovations or similar matters may rely on:
a. information supplied by the Customer;
b. photographs;

i. substitutes for specialist inspection or professional advice.
23. Property Risks
23.1 Radar may identify potential property or location risks where relevant information is available.
23.2 The absence of a risk from a Report does not mean that the risk does not exist.
23.3 Radar is not intended to provide an exhaustive due-diligence investigation of every possible property risk.
23.4 Customers and Clients should obtain specialist advice where a particular risk require
